Entertainment Law

Entertainment Law comprises different conventional laws which concentrate on legal services for the entertainment industry. The intellectual property law also governs the major areas of the Entertainment law. The nature and scope of entertainment law is very broad. The application of entertainment law involves issues of employment law, labour law, immigration, securities law, security interests, agency, trademarks, copyright, right of publicity, insurance law, performer's rights, protection of novel ideas by property, quasi-contract, express and implied contract theories, television packaging deals and motion picture financing and distribution arrangements. In practice, entertainment law mainly involves drafting contracts, negotiation, mediation, litigation and arbitration. The different aspects of entertainment law, other than copyright, includes relationships between artist and personal manager, artist and agent, artist and record producer, and artist and motion picture producer etc. Advertisement law is an important aspect of entertainment law. It includes contract analysis, business practices, intellectual property and government regulations.

Entertainment law can be categorized into different spheres according to the types of activities.
For instance, Film would include Talent agreements of scriptwriters, film directors, actors, composers, set designers, option agreements, finance, chain of title issues, Production and Post production and trade union issues, distribution issues, motion picture industry negotiations distribution, and general intellectual property issues relating to copyright and trademarks. Music would include talent agreements of musicians and composers, producer agreements, synchronization rights, music industry negotiation and general intellectual property issues relating to copyright. Television and Radio including mechanical licenses, broadcast licensing and regulatory issues. Theatre would include rental agreements, co-production agreements and legal issues relating to performance. Multimedia would include software licensing, video game production and development.

Print media and publishing issues, including advertising, models, author agreements and other copyright related issues. Visual arts and design would include fine arts, issues of consignment of artworks to art dealers, moral rights of sculptors regarding works in public places, industrial design, issues related to the protection of graphic design elements in products. The issues of defamation, libel and slander, privacy rights and personality rights are also part of entertainment law.

Every democratic nation has laws to regulate the various branches of public media and mass media. In the wake of the rapid growth and independence of the mass media, there arose the need of some laws and regulations for checks and balances. The legal and political set up of a country determines freedom of the media. The International regulating agency in the arena of media and communications is the International Telecommunication Union which is the prime agency of the UNO for information and communication technologies s of public media and mass media.
