Real Estate Laws

History : The word real means a thing. English common law classifies the word real estate according to the requirement or the basis on which the property is being taxed.

Definations : Ownership rights are determined by various factors. The first type is one where the owner has full and complete right, title and interest on the property with absolute rights to use, enjoy, rent, mortgage or even sell the property. In certain cases the property is leased out to the owner for a specific term, may be 99 years, wherein the owner has the right to enjoy the same but does not have the right to sell or mortgage the property. In a case where the owner of the property dies intestate the property passes to his heirs automatically. The state is usually the owner of the land. The owner is only the owner of the structure on it.

Real Estate : The legal term for immovable property is real estate. It comprises of a piece of land along with all structures on it. Real estate is also known as real property. The terms real estate and real property are used primarily in common law, whereas in civil law, it is known as immovable property. In a broader prospect real property means a thing. Thus there is a difference between real property and personal property. Real Estate is a legal term comprising of real estate along with ownership interests. It is a type of property differentiated from personal property. Real estate is known as heritable property in Scotland, immovable property in Canada, United States, India, Malta, Cyprus, most of Europe, Russia, South America, Malaysia, South Africa, Pakistan, Bangladesh and immobilier in France. Real estate ownership does not only mean the right to its ownership. It includes easement rights, right to ingress and egress.

Types : Land, any constructed structure on the piece of land, flats, apartments and houses.

Area Of Business : In the modern day, real estate business has become the most profitable business. The businessmen who deal with real estates are popularly known as promoters. Another class of people called the brokers also earn their livelihood from this business. They act as a link between those people who are looking for a flat, house, land and the seller or promoter. If the deal is done, then they get a brokerage percentage from both, the promoter as well as from the purchaser.

The banks and other financial institutions also give easy loans for the purchase of real estate property. As a security they keep the concerned property under mortgage till the time the loan is not completely paid off.

The banks also get the property concerned thoroughly checked and valued. Specialized persons called the valuers do the job for the bank.
